Terms and Conditions of Use of the Gift Card

  1.       Scope of Application  

 

  1. These terms and conditions of use of this Gift Card (the "Terms and Conditions") apply to any Purchaser (the "Purchaser") and any holder (the "Holder"; the Purchaser and the Holder together also as "You") of this Gift Card (the "Gift Card"). By purchasing and/or holding the Gift Card, You are agreeing to these Terms and Conditions. 
  1. The Gift Card is issued by Blue Rewards Single Person Company LLC with its registered office at Festival Tower, Dubai Festival City, Dubai, UAE, through a technical service provider, Giftify MENA DMCC.  
  1. The Gift Card is issued and purchased only in the stated currency. It must be purchased in the legal tender currency of the country where it is issued, such as UAE Dirhams (AED). 
  1. No additional funds may be added to the Gift Card after the initial purchase, except in the event that a merchant refunds a transaction on the Gift Card. These terms and conditions are available online at www.mybluereards.com. You may request a copy of these terms and conditions at any time during the term of this contract. 

 

  1. Definitions 

 

  1. “Gift Card” refers to the prepaid card offered under these terms and conditions. It is a prepaid card and should be treated like cash in a wallet or purse. Unless the Gift Card is registered on the website/app, it cannot be replaced if lost, damaged, or stolen. If unregistered and lost or stolen, any funds on the Gift Card will be lost, just as if You lost your wallet or purse. 
  1. "Purchaser/Holder" refers to the contracting party that acquires a Gift Card and makes use of it. The cardholder may or may not be the Purchaser of the card.  
  1. “Seller” or “Shopping Centre” refers to stores in Dubai Festival City, Dubai Festival Plaza, and extends to companies/subsidiaries of the Al-Futtaim Group, where services are provided to Gift Card holders and are authorised to accept the Gift Card. 
  1. "Limited Network" means the establishments highlighted under Article 2.3. 

 

  1. Purchase and loading of the Gift Card 

 

  1. ​​​​​​​If the Gift Card is purchased at a Shopping Centre, the minimum value that can be loaded onto the Card is AED 50 and maximum value that can be loaded onto the Card without verification of the cardholder's identity is AED 3,000 ​​. Gift Card funds will be available for use for up to 12 months after loading. 
  1. The Purchaser of the Gift Card must pay the funds to be loaded on the Gift Card. The activation fee which shall be done through means of deduction of said funds from the amount loaded onto the Gift Card, can be paid separately through another acceptable tender by the Shopping Centre. For a Corporate Gift Card, where the Purchaser is a corporation, then the corporation pays for the funds loaded onto the Gift Card. The activation fee is debited/deducted from the funds loaded onto the Combined Gift or can be paid separately. 
  1. If the Gift Card is purchased over the Internet, the maximum value that can be loaded onto the Card without verification of the cardholder's identity is AED 3,000 ​​. The Gift Card will require an activation before use. This can be done via the Blue Rewards App or www.mybluerewards.com using the Gift Card number and token number found on the Gift Card. 
  1. If the Holder is under 16 years of age, the Purchaser agrees to ensure that these Terms are understood by the user and that use of the Gift Card is supervised if required. 
  1. You can load a Gift Card using a credit or debit card issued by a regulated financial institution, in cash, loyalty points exchange with associated partners of Blue Rewards SPC, cheque (upon payment realization), and any other mode permitted by the card issuer. 
  1. When funds are loaded onto your Gift Card, the payment will be made in the same currency as defined in clause 1.3.  
  1. We may refuse to issue or sell the Gift Card, without any justification and without the Purchaser being able to claim compensation for it. 

 

  1. Using the Gift Card 

 

  1. The Gift Card may be used by the cardholder or may be given to another person (New cardholder) who receives the Gift Card as a gift. When handing over the Gift Card, the buyer must inform the new cardholder of these terms and conditions of use. 
  1. The Gift Card is intended solely for use in the Shopping Centre’s stores and points of sale, and solely for transactions carried out in the presence of the Gift Card Holder.  
  1. Your balance will be reduced by the amount of each purchase You make.  

 

4.3.1.   If any purchase exceeds available funds or card limits, you may add the remaining amount of the purchase with another payment method accepted by the store (credit card, cash, etc.) provided that the Seller accepts a combination of payment methods. 

4.3.2.    Additional funds cannot be added to the Gift Card after purchase. 

  1. The Gift Card is not a debit card backed by a bank account. No interest will be generated on the funds loaded on the Gift Card. 
  1.       You may not use your Gift Card for:  

 

  1. Pre-authorised periodic payments. 
  1. Transactions outside the Shopping Centre. 
  1. Online transactions, even on the websites of the Shopping Centre ’s distributors. 
  1. Cash transactions, including cash repayments, bank withdrawals, postal transfers, travellers’ cheques, foreign currencies or foreign exchange transactions, or; 
  1. Any illegal purpose. 

 

  1. Your Gift Card cannot be used in situations where the Seller is unable to obtain online authorization guaranteeing that there are sufficient funds to complete the transaction. 
  1. It is expected that the Gift Card may be used at points of sale within the Shopping Centre  where Gift cards are usually accepted; but we will not be liable if You cannot use the Gift Card  with any Seller and we will not be liable in any way for goods and/or services purchased from any Seller using the Gift Card. Additionally, we cannot guarantee that the retailers who have agreed to accept the Gift Card  will continue to accept the Gift Card. 
  1. The Shopping Centre is not responsible for the quality, safety, legality or any other aspect of the goods or services purchased with the Gift Card. 
  1. We are not liable for any prohibited use or misuse of the card whatsoever. Furthermore, You acknowledge that the Gift Card  may not be used to: a) purchase goods or services that a retailer is not permitted to supply to You for example, b) a retailer cannot by law sell certain products to You if You are under 18/21 years of age or if such retailer is not licensed to sell such products for purchases over the internet, by email, phone,  or fax. 
  1. The user is responsible for keeping track of the available balance on the Gift Card. To check your balance at any time or to check your previous transactions, please use the Blue Rewards App.  
  1. Transactions that exceed the remaining Gift Card balance are prohibited and will be declined at the point of sale. However, if accepted by a merchant, the amount that exceeds the remaining Gift Card balance can be paid using a different payment method provided that the Gift Card is charged only an amount equivalent to the amount loaded onto or remaining on the Gift Card. 
  1. We are not liable for any failed transaction if You do not have sufficient funds on your Gift Card to cover a transaction, the terminal or system is not working properly, circumstances beyond our control prevent the transaction, or the merchant authorizes an amount greater than the purchase amount. If there is a problem or dispute with the purchase of goods or services, You must address it directly with the merchant involved. Refunds and returns are subject to the merchant’s policies or applicable law. In case of other errors on your Gift Card, contact us on the number mentioned on the card. 
  1. You agree that we can reduce the remaining Gift Card value by the value of all purchases of goods and services that are authorized by You. Transactions are authorized by You when You: a) Swipe your Gift Card  or allow an operator or other user to do so, at an electronic point of sale terminal at a participating retailer, b) give a participating retailer details of the Gift Card  and authorize the transaction in some other way approved by that retailer, c) confirming that the transaction correctly represents the purchase price of the goods or services obtained; and You are agreeing to pay the amount of that transaction by the reduction of the remaining Gift Card  value. 
  1. The Gift Card may not be exchanged or resold and may not give rise to the payment of any monetary consideration. 
  1. You must not alter the Gift Card, or the related services provided in the context of Gift Card usage. 
  1. We may stop, suspend or restrict your Gift Card for reasons related to:  

4.16.1.  The security of your Gift Card/ Gift Card number. 

4.16.2. Suspicion of unauthorized or fraudulent use of your Gift Card. To the extent possible, we will inform You before stopping, suspending or restricting your Gift Card. If this is not possible, we will inform You immediately thereafter. The requirement to inform You does not apply where reasonable security measures are compromised, or it is illegal to do so. 

 

 

  1. Payment Transactions 

 

  1. The Shopping Centre is entitled to assume that a transaction is authorized by You where the Gift Card's magnetic stripe is swiped by the seller, or where appropriate information is provided to the Seller in order to allow the transaction to be carried out.  
  1. A transaction cannot be cancelled once it has been transmitted to us with your authorization. Typical refusal grounds are: 
  1. A transaction exceeds the funds available on the Gift Card. 
  1. If the Shopping Centre has reasonable grounds for doing so under the rules of the payment system (Visa or MasterCard) for which your Gift Card was issued; or 
  1. If the Shopping Centre has reasonable grounds to believe that such action is necessary in order to comply with any legal obligation. 
  1. The Shopping Centre may not carry out transactions in the event of force majeure or technical problems attributable either to the Shopping Centre or to the seller. 

 

  1. Transactions in Foreign Currencies 

 

  1. The Gift Card may only be used for transactions in the currency of the Card. 

 

  1. Checking Your Balance 

 

  1. To check the available balance on your card or to review your transactions, kindly use the Blue Rewards App. Alternatively to check balance You can also visit www.mybluerewards.com or, depending on availability, call the Shopping Centre  number mentioned on the reverse side of the Gift Card.

  1. Card Expiration 

 

  1. Both your Gift Card and the balance loaded onto it will expire 12 months after the Card's loading date, which is known as the “Expiration date". On that date, the Card will cease to function and may not be used as a method of payment. 
  1. The expiration details can be viewed in the Blue Rewards App. You can also check that date at the Shopping Centre. 
  1. Once your Gift Card has expired, the remaining funds cannot be used. You will not be entitled to any refund of your card balance.  

 

  1. Security Precautions 

 

  1. Your Gift Card should not be used by a third party without permission. 
  1. Only use the Gift Card or its number to enter (or undertake to enter into) a transaction. 
  1. If your Gift Card is lost or stolen, or if You believe that it (or its number) may have been used illegally, You must:  
  1.  Block your Gift Card through the Blue Rewards App.  
  1. Immediately stop using your Gift Card and its number.  
  1. If You find the Gift Card after reporting that it has been lost, stolen, or illegally used, You must destroy it and notify your Shopping Centre as soon as possible. 
  1. You will be responsible for any use of your Card until You have notified your Shopping Centre. 
  1. If your Gift Card, or any replacement card, is lost or stolen, You may, once the loss is reported, request a replacement card from the Shopping Centre. You will be charged a fee before a replacement card is  issued. This is further explained in the summary table at the end of this document. If any of these should occur to the Gift Card-- loss, theft, damage or, misuse, access the Blue Rewards App immediately and follow the process to block your Gift Card. Once done, You can visit the nearest Shopping Centre if You seek more information, or a replacement Gift Card. We will work on your request and cancel your Gift Card. If the Gift Card holds funds of up to at least AED 20, we will replace it with a new Gift Card. Any remaining balance will be transferred to the new Gift Card. In case You wish to unblock your card, You can do so through the Blue Rewards App. 
  1. We are not responsible for: 
  1. Any abnormal or unforeseeable circumstances, for example, a failure of computer systems that occurs for reasons beyond our control, if this prevents us from providing a regular service. 
  1. Any vendor who refuses to accept (or is late in accepting) your Card or Card number. 
  1. In case of errors about transactions, call your Shopping Centre ’s helpline. 
  1. If your Gift Card is not working properly, You can get a new one at the point of sale in the Shopping Centre. The      remaining balance of your card will be transferred to the new Card. 
  1. Our liability in any event is limited to the balance on the Gift Card. 
  1. Balances that have already been used before the Gift Card is blocked cannot be refunded. 
  1. Any use that does not respect these terms and conditions may result in the blocking of your Gift Card. 

 

  1. Modification of Terms and Conditions of Use 

 

  1. The terms and conditions of use, as well as the prices and additional charges, may be modified at any time. 
  1. If modified, the terms and conditions of use applicable shall be those in force and shall supersede the earlier version(s). 
  1. We may from time to time change these Gift Card Terms and Conditions. Such actions are necessary for the purposes of protecting electronic funds from misuse, fraud prevention, overcoming operational difficulties, complying with applicable laws or regulations, or making more efficient the process of the Gift Card. These may include (but are not restricted to): a) Making changes to these Terms; b) cancelling the Gift Card and refunding any balance due; c) declining to authorize transactions; d) suspending or restricting all or part of the operation of the Gift Card and/or the Security Code e) instructing a Seller to retain the Gift Card. 
  1. If we do any of the above, we will notify You and in a manner that is reasonably practicable (unless circumstances dictate otherwise). 

 

  1. Complaints and Disputes 

 

  1. The Shopping Centre will do its best to resolve any disputes over these Terms. 
  1. Please refer to the FAQs in the Blue Rewards App or visit www.mybluerewards.com. If You wish to contact us for any other reason related to these terms and conditions, please reach out via the channels mentioned below.

  1. Before initiating any contentious procedure, an amicable solution should be sought. 
  1. Telephone calls to and from us may be monitored and/or recorded. 
  1. The governing law and jurisdiction for the Terms and Conditions are governed by and shall be construed in accordance with the laws of the Emirate of Dubai and the Federal Laws of the UAE and You hereby submit irrevocably to the non-exclusive jurisdiction of the civil courts of the Emirate of Dubai. Such submission shall however not prejudice the rights of the Issuer to bring proceedings against You in any other jurisdiction. 
  1. To the extent permitted by law, we will not be liable to You for any loss or damage (whether direct or consequential), nor be in default under these Gift Card Terms and Conditions, for failure to observe or perform any of our obligations for any reason or because which could not, with reasonable diligence, be controlled or prevented. These causes include, but are not limited to, acts of God, acts of nature, acts or omissions of government or their agencies, strikes or other industrial actions, fires, floods, storms, riots, power shortages/failures, sudden and unexpected system failures, disruption by war or sabotage, and other acts or omissions of third parties. 

 

 

  1. Privacy 
  1. Giftify and the Shopping Centre agree to take all necessary measures to protect the confidentiality of the user's data. The personal information collected is processed only in a lawful manner and in compliance with applicable regulations. 
  1.  You irrevocably authorize and permit the Issuer to disclose and furnish such information that it deems fit concerning You including but not limited to the card governed by these Terms and Conditions to the Issuer’s authorized representatives, subsidiaries, associates, branches, assignees, agents or other connected parties (including the Issuer’s third-party advisers and marketing partners) or any other party at the Issuer’s discretion. 
  1. The Issuer shall also be at liberty to share the necessary information relating to You with the selected Gift Card brand partners for the purpose of cross selling and marketing of goods and service to You and in relation to which the Issuer has entered into a formal agreement with such partners. You have the option of deselecting such a value-added service by expressly notifying the Issuer in writing including your Token number. 
  1. The Issuer shall have an unconditional right to disclose any information in relation to You if such information is generally available to third parties, or is lawfully in our possession, or is sought by a court of competent authority, governmental body or regulatory authority (including the Central Bank).  
  1.  The governing law and jurisdiction the Terms and Conditions are governed by and shall be construed in accordance with the laws of the Emirate of Dubai and the Federal Laws of the UAE, and You hereby submit irrevocably to the non-exclusive jurisdiction of the civil courts of the Emirate of Dubai. Such submission shall however not prejudice the rights of the Issuer to bring proceedings against You in any other jurisdiction. 

 

 

 

 

​​​13​​. Summary 

 

This table summarises the key characteristics and information of the product. Also listed below are the balance limits and possible additional charges that apply to each Gift Card. The entire value of the Gift Card should be used before the end of the Card Validity Period (which shall occur 12 months from the date of purchase). Upon the Expiry Date, the Gift Card will become invalid. After expiry, the Gift Card cannot be reactivated and all amounts remaining on the Gift Card will be lost. If You contact us before the expiry of the Gift Card to reactivate your card and provided your Gift Card holds funds of at least AED 20, You will be provided with a Replacement Gift Card and your funds will be transferred to the Replacement Gift Card with a deduction of AED 15, which shall be charged as a replacement and a reactivation Fee. Further, unless otherwise specifically stated in the User Guide, once the Gift Card and/or the Replacement Card have expired, the Available Funds in the Card will not be refunded to You in any form whatsoever.
